The petitioner seeks bail in a case registered for offences punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016, and Sections 272 and 273 of the IPC.

It is contended that, as per allegation, 16.5 litres foreign liquor was recovered from the house of the petitioner. It is urged that nothing was recovered from the physical possession of the petitioner and only on the basis of suspicion, he was apprehended by the police. It is further contended that in the said house, altogether 22 tenants and owner of the house were residing which also creates doubt that who has kept the liquor. Having regard to the facts and the circumstances of the case, the abovenamed petitioner is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Patna in connection with Special Case No. 7590/18 arising out of Kankarbagh P.S. Case No. 749/2018.

Further, if the petitioner, after his release in this case, is again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of his bail bond.
