2. The petitioner is apprehending his arrest in Araria P.S. Case No. 28 of 2021 registered under Section 365 of the IPC.
3. As per allegation, some unknown accused persons are said to have kidnapped the daughter of the informant.
4. Learned counsel for the petitioner has submitted that petitioner is innocent and has falsely been implicated in the present case. As a matter of fact, there was love and affection between the petitioner and the alleged victim. It has further been submitted that in pressure of her family members, she has supported the prosecution case in her statement recorded under Section 164 of the Cr.P.C./ 183 of the BNSS, 2023. It has also been submitted by annexing tickets that the victim returned to the petitioner's place along with her brother and then she travelled to
Patna High Court CR. MISC. No.18763 of 2025(4) dt.15-10-2025 2/2 Vaishno Devi with the petitioner. Thereafter, the petitioner along with the victim girl came to Araria and then she returned to petitioner's place with her mother and brother. Paragraph 38 of the case diary shows that the victim has refused for her medical examination. The petitioner is a person of clean antecedent.
5. Learned APP Mr. Shailendra Kumar has opposed the prayer for anticipatory bail.
6. Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Araria P.S. Case No. 28 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure/ 482(2) of the BNSS, 2023. (Nawneet Kumar Pandey, J) priyanka/- U T
