JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-06-2019 This is an application for grant of anticipatory bail in connection with Taraiya P.S. Case No. 41 of 2018, disclosing offences under Sections 304(B), 34 of the Indian Penal Code. Petitioner happens to be the husband of the deceased and the case is dowry death.
Submission of the learned counsel for the petitioner is that as a matter of fact, she committed suicide and the informant has also participated in cremation of the dead body which was performed by the petitioner and thereafter, due to some reason, the present case has been lodged.
Heard learned A.P.P. also, who has opposed the prayer for bail on the ground that there are statements of the witnesses that he has demanded Rs.50,000/- and colour TV and for that assaulted the deceased also and have also disclosed that the cause of death by hanging her.

No.21026 of 2019(3) dt.20-06-2019 2/2 Having heard both sides, in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail, the same shall be considered by the learned trial court on its own, without being prejudiced by order of this Court.
