JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-302, 120-B of the Indian Penal Code and under Section27 of the Arms Act. Petitioner is named but it is specific case of the prosecution that it were co-accused Suraj Kumar and Deenanath Mahto, who shot fire on the deceased and so far as petitioner is concerned; it is stated that he along with some others made indiscriminate firing.

Learned counsel for the petitioner points out that the deceased sustained only three fire-arm injuries and moreover, coaccused Sunny Kumar and Chandan Yadav, having more or less

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Muzaffarpur Town P.S. Case No. 608 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur.
