The following reliefs as formulated by the petitioners have been claimed in the writ petition- "(i) For issuance of writ (s) or direction to the respondents to remove the sand and soil from the raiyati land of the petitioners situated at mauza Nizamuddin pur, Dhibra Pargana Fulwari, P.S.- Shahpur, District-Patna bearing Survey Thana No.33, Khata No.21, C.S. Plot No.469 (part) having a dimension of average 110 feet and 6 inch north to south and 14 feet east to west total area 1540 square feet.

At the very outset, learned counsel for the petitioners submits that it will suffice if the present writ petition is disposed of by granting liberty to the petitioners to file a representation before the appropriate authority for redressal of their grievance, and without going into the detailed merits of the matter.

4. Learned counsel for the respondents is present.

5. Having regard to the stand of the petitioners, the writ petition is disposed of, with liberty to the petitioners to file a representation before the concerned authority for redressal of their grievance within a period of three weeks from today. If any such representation is filed within the aforesaid period, the same shall be considered and disposed of on its own merits in accordance with law and after grant of an opportunity of hearing to the petitioner, expeditiously and in any event preferably within a period of three months thereafter.
