Learned counsel for the petitioner is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.

This application for anticipatory bail arises out of Teghra P.S. Case No. 19 of 2021 for the offence punishable under Section 30(a) of the Bihar Prohibition & Excise Act. The petitioner claims to be the father of the person who was arrested doing the business of illicit liquor. He further submits that the son of the informant namely, Amarish Sah is in custody.

Considering the aforesaid facts, this application is allowed.

Let the petitioner, above named, in the event of his

Patna High Court CR. MISC. No.29424 of 2021(2) dt.10-12-2021 2/2 his arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-Special Judge, Excise Act, Begusarai, in connection with Teghra P.S. Case No. 19 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

However, before accepting the bail bonds of the petitioner the Court below shall verify whether the son of the petitioner namely, Amarish Sah is in custody or not in connection with present case. If the statement is found to be true then the Court below shall accept the bail bonds of the petitioner and if the statement is found to be false, the Court below shall not accept the bail bonds of the petitioner.
