The petitioner seeks anticipatory bail in connection with Barahiya P.S.Case No. 19 of 2014 registered for the offences punishable under sections 364, 302, 379 and 120-B read with 34 of the Indian Penal Code.
It has been contended that the petitioner is neither named in the F.I.R. nor any cogent material could be collected against him in course of investigation. Some other co-accused persons against whom there is similar allegation have already been granted bail by this Court.
On the other hand, learned counsel for the State has opposed the prayer for anticipatory bail. He has submitted that it
Patna High Court Cr.Misc. No.41486 of 2014 (2) dt.27-03-2015 2/2 would be manifest from the impugned order passed by the learned Additional Sessions Judge that the name of the petitioner transpired in course of investigation by one Badan Kumar and others. The offence relates to kidnapping and murder of two innocent persons.
Regard being had to the gravity of offence, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail is rejected. (Ashwani Kumar Singh, J) Pradeep/- U T
