2. The petitioner is in custody in connection with Akbarpur P.S Case No. 426 of 2023 from the Court of learned J.M First Class, Nawada registered for the offences punishable under Sections 379 of the I.P.C.
3. As per allegation in the FIR, at night petitioner parked his motorcycle on the Varandah of his house but in the morning informant saw that his motorcycle was not found there.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. Petitioner
Patna High Court CR. MISC. No.22340 of 2024(2) dt.03-04-2024 2/2 is not named in FIR during the course of investigation concerned motorcycle recovered from the house of the petitioner. It is also submitted that petitioner is in judicial custody since 12.10.2023 and petitioner has got one criminal antecedent as stated in para 3 of the petition.
5. However, learned APP for the State oppose the prayer for regular bail of the petitioner
6. In view of the allegation and as regard to recovery of concerned motorcycle from the petitioner's house this Court is not inclined to grant bail to the petitioner.
7. Hence the prayer for regular bail of the petitioner is hereby rejected. However, the petitioner may renew his prayer of bail after examination of victim and learned trial court is directed to complete trial in this case within a period of six months from today.
