As prayed, learned counsel for the petitioners is permitted to implead the Chief Executive Officer, Patna Municipal Corporation, Patna as respondent no.6 in course of the day.
It is contended on behalf of the petitioners that petitioners are getting family pension. The pension has been revised on 29.06.2012 but difference amount after revision has not been paid to the petitioners. Accordingly, this writ petition is being disposed of with liberty to the petitioners to approach the respondent No.6 by filing a fresh representation giving all the details. On such representation having been filed the Chief Executive Officer of the Municipal
Patna High Court CWJC No.15842 of 2015 dt.06-05-2016 2/2 Corporation shall call for the record from the concerned department and consider the case of the petitioners and take a decision in accordance with law. If some amount is required to be paid then steps should be taken for immediate payment to the petitioners, however, if the petitioners' claim does not find favour with the Municipal Commissioner, then a reasoned order will be passed. It is expected that the whole exercise would be completed within a period of three months from the date of receipt/production of a copy of this order along with representation of the petitioner.
