Petitioner seeks bail in a case registered under Sections-272, 273 of the Indian Penal Code and Section-47(A) of the Excise Act.

164 bottles containing 400 ml. each of the bottles of country-made liquor, 20 litres spirit and other apparatus are said to have been recovered near a tree. The informant claims that the petitioner, having seen the police officials, managed to escape from there. The aforesaid fact goes to show that petitioner was neither caught on the spot nor anything was recovered from his conscious possession. The petitioner is languishing in jail custody since 07-06-2016 without having any criminal antecedent.

Patna High Court Cr.Misc. No.31608 of 2016 (2) dt.16-08-2016 2/2 Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Vidyapatinagar P.S. Case No. 114 of 2015 to the satisfaction of Sri P.K. Rai, learned Judicial Magistrate-Ist Class, Samastipur.
