JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-307, 379 & other minor sections of the Indian Penal Code.

The present case was lodged against 57 named and 50 unknown persons including the petitioner.

The accusation against the petitioner and other accused is that they blocked main road in protest of death of a person, who died in an accident and when the police party and other official reached there to remove the blockage, the petitioner and his associates became violent and started pelting bricks and stones, causing injury to several police officials.

Patna High Court Cr.Misc. No.28537 of 2016 (2) dt.19-07-2016 2/2 Submission on behalf of petitioner is that petitioner is in jail custody since 30-04-2016 and having more or less similar allegation, some co-accused persons have already been granted privilege of bail.

Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Gurua P.S. Case No. 48 of 2016 to the satisfaction of learned Sub Divisional Judicial Magistrate, Sherghati at Gaya.
