JUSTICE ARVIND SRIVASTAVA ORAL ORDER 19-01-2017 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. The petitioners are apprehending their arrest in Chautham P.S. Case No.101/16 for the offences under Sections 147,148, 149, 341, 323, 307, 504 of the I.P.C. and 27 of the Arms Act.
There is allegation of assault with riffle against the petitioners.
Submission of the petitioners is that there is land dispute between the parties. They have no criminal antecedent. There is case and counter case. There is omnibus and general allegation against the petitioners. Similarly situated co-accused have already been granted anticipatory bail by this Court vide
Patna High Court Cr.Misc. No.1836 of 2017 (2) dt.19-01-2017 2/2 Cr.Misc. No.52908/16 on 21.12.2016.
Under the above circumstances, let the petitioners, above named, in the event of their arrest or surrender before the court below within four weeks from today be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of C.J.M., Khagaria, in Chautham P.S. Case No.101/16 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
