JUSTICE ARUN KUMAR ORAL ORDER 22-03-2017 Learned counsel for the petitioner is directed to correct the name of the petitioner during the course of the day in the bail application.

Heard learned counsels for the petitioner and the State.

The petitioner apprehends his arrest in connection with Vaishali (O.P Belsar) P. S. Case No. 129 of 2016 (G.R.No. 2169 of 2016) instituted under Sections 147, 148, 149, 323,324, 342, 307, 427 and 504 of the Indian Penal Code. The allegation, in brief, is that due to land dispute the petitioner alongwith others assaulted the informant's side. The specific allegation against this petitioner is that he had assaulted with Chopper to the informant and one Md. Nasim Mian. Learned counsel for the petitioners submits that there

No.5651 of 2017 (3) dt.22-03-2017 2/2 is case and counter case between both sides and there is land dispute also and the injury attributed to the petitioner is simple in nature and he has no any criminal antecedent. Having considered the aforesaid facts and circumstances, let the petitioner, namely, Md. Kurban, in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Vaishali (O.P-Belsar) P.S.Case No. 129 of 2016 (GR No. 2169 of 2016); subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
