The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 341, 342, 323, 324, 504, 506, 307, 379/34 of the Indian Penal Code. As per FIR, informant alleged that the accused persons including the petitioner were demanding extortion of Rs. 5000/- from him and the petitioner assaulted the informant by means of knife due to which informant sustained cut injuries on his lips. It is further alleged that the petitioner also snatched mobile, cash of Rs. 35,000/- and other articles worth Rs. 12,000/-.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has

As per injury report, which is annexed as Annexure-3, it appears that the informant sustained three injuries, one incised wound on lower lip, traumatic pain of whole body and one excised wound caused by sharp object and doctor opined, excised wound injury simple in nature. It is further submitted that the petitioner is languishing in judicial custody since 13.01.2023. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Lakhnaur P.S. Case No. 46 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Ist Jhanjharpur District Madhubani.
