02. In the present case, the petitioner seeks bail in connection with Baikunthpur P.S. Case No. 418 of 2024 registered for the alleged offences under Sections 12692), 115(2), 118(1), 109, 303(2), 3(5) of Bharatiya Nyaya Sanhita, 2023.

03. As per prosecution case, the petitioner and coaccused persons armed with knife stabbed the uncle of the informant. Other family members of the informant were also assaulted by the other co-accused persons with knife, Lathi, Bhala and Farsa.

04. Learned senior counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The present case is counterblast of Baikunthpur P.S. Case No. 423 of 2024 lodged by one Rukmani Devi, the mother of the petitioner. Learned senior counsel further submits that a number of persons from the petitioner's side have also received injuries for which there is no explanation. One of the co-accused persons, namely Om Prakash Rai, has received grievous injury. The informant side was trying to grab the land of the petitioner for which a Panchayati was held. In this Panchayat, scuffle took place and in a free fight, a number of persons sustained injuries. Learned senior counsel further submits that the petitioner is having antecedent of one case in which he is on bail. The petitioner is in custody since 22.12.2024 and chargesheet has been submitted.

05. Learned APP for the State as well as learned counsel for the informant oppose the prayer for bail.

06. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the period of custody of the petitioner along with submission of charge-sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten

No.19984 of 2025(3) dt.23-07-2025 3/3 thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Gopalganj in connection with Baikunthpur P.S. Case No. 418 of 2024, subject to the conditions mentioned in Section 480(3) of BNSS and the following conditions:

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
