The petitioner seeks bail in a case registered under Sections 363, 366, 307, 324, 34 of the Indian Penal Code. Prosecution case in short is that at night while the informant was sleeping along with her younger daughter, three FIR named accused persons wrapping their mouth with Gamchha came and forcibly kidnapper her daughter. In the episode, on protest, persons from informant's side were assaulted.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 03-11-2018. Charge sheet has

Patna High Court CR. MISC. No.18999 of 2019(4) dt.08-08-2019 2/2 already been submitted. There is no allegation of physical or sexual assaulted alleged against the petitioner. The victim has already been recovered. The other co-accused with similar allegation has been granted bail by a coordinate bench of this court vide order dated 28-02-2019 passed in Cr. Misc. Nos. 17287 of 2019.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-Ist Class, Udakishunganj, Madhepura in connection with Puraini P.S. Case No. 204 of 2018.
