JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section-353, 307 & other minor sections of the Indian Penal Code and 27 of the Arms Act.

The name of petitioner came in this case in confessional statement of co-accused Pintoo Yadav, who was caught on the spot.

It would appear from perusal of the first information report that petitioner and others allegedly, committed loot of crop of one Baleshwar Yadav and having got the aforesaid information, when police party proceeded towards the place of occurrence of the said case, the petitioner and others allegedly, opened fire on

Learned counsel for the petitioner points out that coaccused Pintoo Yadav has already been granted privilege of bail by a coordinate bench of this court and the case of the petitioner is on better footing to that of co-accused Pintoo Yadav. Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Dharahara P.S. Case No. 35 of 2016 to the satisfaction of Sri Sone Lal Rajak, learned Judicial Magistrate-Ist Class, Munger.
