JUSTICE ARUN KUMAR ORAL ORDER 07-02-2017 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners apprehends their arrest in connection with Digha P.S. case No. 121 of 2016 instituted under Sections 341, 323, 379 and 506 of the Indian Penal Code. The allegation, in brief, is that the petitioners quarreled and assaulted the informant and committed theft. It is submitted that due to family dispute the petitioners have been falsely implicated in this case. Petitioner No. 1 is the own brother of the informant, Petitioner no. 2 is the wife and rest other are relatives and they are residing in the same house. The petitioners

Considering the aforesaid facts and circumstances of the case, let the petitioners, namely, Pramod Kumar, Rubi Devi, Ashok Rai, Vikram Kumar and Suraj Kumar in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Patna in connection with Digha P.S. case No. 121 of 2016; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
