JUSTICE MOHIT KUMAR SHAH ORAL ORDER 11-03-2026 The present petition has been filed for restoration of a writ petition bearing CWJC No. 17283 of 2024, which has been dismissed for default on account of non-compliance of the peremptory order dated 20.11.2024.

The Ld. Counsel for the petitioner submits that he was not aware of the peremptory time granted for removal of the defects, hence the defects could not be removed within time, leading to the present writ petition having been dismissed

Patna High Court MJC No.1033 of 2025(4) dt.11-03-2026 2/2 for default. Thus it is submitted that a sympathetic view be taken and the aforesaid writ petition be restored to its original file.

Having regard to the facts and circumstances of the case, considering the submissions made by the Ld. Counsel for the petitioner as also considering the averments made in the present petition, I deem it fit and appropriate to direct for restoration of the aforesaid writ petition bearing CWJC No. 17283 of 2024 to its original file, subject to removal of the defects pointed out by the registry, within a period of four weeks from today. 4.

Accordingly, the present petition stands disposed off on the aforesaid terms.
