JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-05-2019 This is an application for grant of anticipatory bail in connection with Jehanabad P.S. Case No.643 of 2018 disclosing offences under Sections 363 & 366A of the Indian Penal Code. Allegation against the petitioner is of kidnapping the minor daughter of the informant.

Submission of the learned counsel for the petitioner is that the statement of the girl has already been recorded under Section 164 of Cr.P.C. that does not disclose the story of kidnapping or abduction. It shows that the victim has gone with the petitioner on her own sweet will and married with the petitioner.

Heard learned A.P.P. as well as learned counsel for the opposite party no.2 also, who has opposed the prayer for bail on the ground that victim is minor.

Having heard both sides, considering the above

Patna High Court CR. MISC. No.22357 of 2019(3) dt.13-05-2019 2/2 submission, especially the statement of the girl that she had married with the petitioner and wants to reside with him, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Jehanabad, in connection with Jehanabad P.S.
