The petitioner has filed the instant application for quashing the order dated 23.1.2021 by which the petition for release of vehicle seized in connection with Muzaffarpur (Sadar) P.S. Case no. 45 of 2020 registered besides other sections under the Bihar Prohibition and Excise Act, 2016, was rejected by the learned Special Judge, Excise Act, Muzaffarpur. Learned counsel for the parties agree that the instant application is covered by the Division Bench judgment of this Court dated 10.6.2021 passed in C.W.J.C. No. 7281 of 2021
