Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 21, 22 of the N.D.P.S Act.

200 gms of Ganja was recovered from the house of the petitioner.

It is submitted by learned counsel for the petitioner that recovery is from the joint family house. Moreover there is no seizure list on the record.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the quantum of seizure from joint family house, without being any seizure list on record, let the learned Court below pass appropriate order for release of

Patna High Court Cr.Misc. No.34301 of 2015 (2) dt.25-08-2015 2/2 the petitioner on bail, if he surrenders within a period of six weeks in connection with Tajpur(Halai O.P.) P.S. Case No. 435 of 2014, pending in the Court of learned District & Sessions Judge, Samastipur.

Accordingly the application is disposed of.
