====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 23-11-2021 Heard the learned Advocate for the petitioner and the learned APP for the State.

The petitioner seeks bail in connection with Sessions Trial No.261 of 2020 arising out of Purushottampur P. S. Case No.56 of 2019, instituted for the offences under Sections 399 and 402 of the Indian Penal Code and Sections 25(1-B)a, 26 and 35 of the Arms Act.

From bare perusal of the allegation as alleged in the F.I.R., it would manifest that the police apprehended one Munna Alam @ Md. Anwar and on search, a loaded pistol with live cartridge was found from his waist and said apprehended person disclosed the name of another five persons including the petitioner.

No.29414 of 2021(2) dt.23-11-2021 2/2 Learned counsel for the petitioner submits that nothing has been recovered from his possession and his name has come on the confessional statement of co-accused, who was apprehended by the police. The petitioner is in custody since 18.06.2020 and charge-sheet has been submitted in this case. Learned A.P.P. opposed the prayer.

Considering the facts afore-stated, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 5th Additional Sessions Judge, West Champaran at Bettiah in connection with Sessions Trial No.261 of 2020 arising out of Purushottampur P. S. Case No.56 of 2019. The application stands allowed.
