JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 31-01-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner apprehends his arrest in connection with Kusheshwar Asthan P.S. Case no. 150 of 2016, registered under Sections 498(A), 341, 323, 379/34 of the Indian Penal Code and Section 3/4 of Dowry Prohibition Act. The accusation is of torturing of informant by her husband and other in-laws due to non-fulfillment of demand of dowry and ousting from her matrimonial house. Learned counsel for the petitioner submits that petitioner is still ready to keep the informant as his wife with full dignity, but she is not ready to live with the petitioner. The said facts has also been detailed in A.B.P. No. 249 of 2016, dated 19.10.2016 passed by Sessions Judge, Camp Court at Benipur,
Patna High Court Cr.Misc. No.2085 of 2017 (2) dt.31-01-2017 2/2 Darbhanga. Further submission is that notice was also issued by the learned Sessions Judge at the time of disposal of the Anticipatory Bail Application, but informant did not appear before the Court.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Benipur, Darbhanga in connection with Kusheshwar Asthan P.S. Case No. 150 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
