There is no representation on behalf of the State. The admitted position is that the petitioner's mother has applied for petitioner's appointment on compassionate ground on 13.07.2011, whereas the death of the father, who died in harness was on 01.04.2006. It is thus not in dispute that application was made by petitioner's mother who was second wife of the deceased, but after the lapse of five years and thus, not maintainable.

Patna High Court CWJC No.17979 of 2014(4) dt.06-12-2022 2/2 Learned counsel for the petitioner, however, has submitted that there was some dispute regarding succession which led to belated application. He has not been able to show that there is any provision which allowed for extension of his time or that the order rejecting his claim is factually or legally unsustainable.

In view thereof, no case is made out, accordingly, the same is dismissed.
