The petitioner apprehends his arrest in Buxar Rail P.S. Case No. 86 of 2016 instituted for the offences under Sections 414 of the Indian Penal Code, Section 25(1-b)A, 26, 35 of the Arms Act and Section 147 of the Railway Act. It has been submitted on behalf of the petitioner that name of the petitioner has been disclosed by coaccused Arvind Kumar who was apprehended on the spot and incriminating articles including fire arm were recovered from his possession. From the written report itself, it appears that petitioner was not present at the place of occurrence and his name was disclosed by the co-accused Arbind Kumar who was apprehended on the spot by the police. It is further submitted that petitioner has no criminal antecedent.

In the event of surrender/arrest of the petitioner, named above, within six weeks from today in connection with Buxar Rail P.S. Case No. 86 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Railway, Ara, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
