Petitioner prays for bail in connection with Bettiah (M) Banuchhapar P.S.Case No. 99 of 2018 registered for the offences punishable under Sections 399, 402 of the Indian Penal Code and 25(1-B)(a), 26 and 35 of the Arms Act.

Allegation against the petitioner is of recovery of country made pistol from his possession while he along with others was preparing to commit dacoity.

Submission of learned counsel for the petitioner is that petitioner has falsely been implicated in this case and he is in custody since 14.3.2018, having no criminal antecedent and similarly situated co-accused has been granted bail by this Court vide order dated 20.9.2018 passed in Cr.Misc.No. 47623 of 2018.

Having heard both sides and in the facts and circumstances, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, West Champaran, Bettiah, in connection with Bettiah (M) Banuchhapar P.S.Case No. 99 of 2018, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
