The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 307, 353, 353A, 333, 338, 295A, 153, 153A, 435, 337, 379, 427, 506 and 504 of the Indian Penal Code.
The prosecution case is that 200 persons were going to immerse the Idol of Goddess Laxmi when the procession diverted the route and tried to proceed through Muslim area. On protest being made by Muslim community the police tried to pacify the issue when the stones were pelted from both side as a result the mob became violent and ransacked the
Patna High Court Cr.Misc. No.36037 of 2015 (2) dt.21-08-2015 2/2 shops and tried to put them on fire.
It is submitted by learned counsel for the petitioners that the accusation is against the mob and none received any substantial injury.
A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the accusation against the mob, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Sahar P.S. Case No. 164 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
