Petitioner seeks bail in a case registered for the offences punishable under Sections 121, 121A, 120B of the Indian Penal Code, Section 25(1-b)a, 26, 35 of the Arms Act, Sections 16, 17, 18, 19, 20, 21, 22 of the U.A.P.A. (Unlawful Activities (Prevention) Act and Section 17 of the Criminal Law Amendment Act.
The petitioner is in custody since 19.12.2018. Petitioner has stated on oath that he has got no criminal antecedent. His name surfaced in the confessional statement of other two co-accused who were apprehended at the spot and arrested by the police.
Considering the nature and material and grant of bail to some other similarly situated co-accused by a Coordinate
Patna High Court CR. MISC. No.18616 of 2019(2) dt.01-05-2019 2/2 Bench of this Court vide Annexure 2 series, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Belhar Police Station Case No. 127 of 2018, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
