2. The petitioner seeks regular bail in connection with N.D.P.S. Case No. 33 of 2022, arising out of N.C.B. 24/2022, registered for the offence punishable under Sections 8(c), 20(B) (ii)(c), 29 of the N.D.P.S. Act.

3. As per the prosecution, the recovery is of 600 kg. of Ganja and the petitioner was caught on the spot.

4. It has been submitted by learned counsel for the petitioner that petitioner was labour and for carrying the Ganja. The petitioner is in jail since 20.12.2022 and out of eight witnesses, two witnesses have been examined.

5. The learned Central Govt. counsel for the Union of India, Ms. Shail Kumari, submits that she has filed counter

Patna High Court CR. MISC. No.23311 of 2024(6) dt.27-09-2024 2/2 affidavit and has opposed the prayer for bail. She submits that the petitioner was involved in the carrying of Ganja, therefore, he does not deserve regular bail in such a huge recovery.

6. Considering the fact that the trial has started and considering the fact that there is huge recovery of Ganja, I am not inclined to grant bail to the petitioner for the present.

7. This application is dismissed.

8. The Prosecuting agency is directed to bring the witnesses on the date fixed so that trial is not delayed by the prosecution. The Special Judge, Supaul will also take all steps for early disposal of the trial.

9. Let a copy of this order be communicated to the District Judge, Supaul through Fax/E-Mail forthwith for compliance with the order.
