JUSTICE SANJAY PRIYA ORAL ORDER 06-02-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks anticipatory bail in a case instituted for the offence under Sections 420, 406, 467, 468, 471 and 120(B) of the Indian Penal Code.

It has been submitted on behalf of the petitioner that he is father of the main accused Kishore Kr. @ Vickey whose anticipatory bail has already been rejected. There is no allegation of overt act against this petitioner.

The counsel for the informant has submitted that the Sessions Judge has referred to various paragraphs in the impugned order, therefore, the case diary would be required. From the written report itself, this Court finds that

Patna High Court Cr.Misc. No.3346 of 2017 (2) dt.06-02-2017 2/2 there is mere allegation against the petitioner that he agreed to return money. Besides this, this Court does not find any allegation of overt act against the petitioner.

Considering the facts and circumstances of the case, let the petitioner above named in the event of surrender within six weeks from the date of receipt of this order, in connection with Nawada Town P.S. Case No. 575 of 2016, shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nawada, subject to the conditions as laid down under Section 438 (2) Cr. P.C. (Sanjay Priya, J) S.Ali/- U T
