JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 10-02-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.
In this application for anticipatory bail the petitioner apprehends his arrest in connection with Ara Nawada P.S. Case No. 617 of 2016 for the offences punishable under sections 341, 323, 504, 307, 337, 338 and 379/34 of the I.P.C and section 27 of the Arms Act.
Allegedly, in the occurrence the petitioner gave rod blow on the head of the informant causing injury to him and others assaulted with bricks, stones and lathi.
Submission is of false implication and that this is counter blast case of Ara Nawada P.S. Case No. 598 of 2016
Patna High Court Cr.Misc. No.2803 of 2017 (2) dt.10-02-2017 2/2 which is lodged by Deepak Kumar wherein the informant and others are accused, both parties have received injuries, the injury received is simple in nature and as such the petitioner deserves sympathetic consideration.
The learned A.P.P. submits that two injuries were on head of the informant.
In the facts and circumstances as stated above, considering that the injuries found are simple in nature and as such the petitioner, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. C.J.M. Ara in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
