The petitioner is apprehending his arrest in connection with Complaint Case No.490(C) of 2018 , registered for offences punishable under Sections 406, 420, 504, 120B of the Indian Penal Code.
Complainant is the Director of Dhiraj Herbs Pvt. Ltd. and there is allegation that the petitioner and other accused persons who are retailers for selling Ayurved medicine have sold the medicine but not deposited the amount in the Firm and causing loss of Rs.15 lac.
Submission of the learned counsel for the petitioner is

No.18466 of 2019(4) dt.19-06-2019 2/3 that he is Sales Officer and he was directed to collect the dues from the retailers and he has no hand in selling those medicines and furthermore other accused persons who were dealers have been granted anticipatory bail by different Benches of this Court, vide order dated 12.4.2019 passed in Cr. Misc. No.23142 of 2019 and order dated 15.5.2019 passed in Cr. Misc. No.8693 of 2019.
Heard learned A.P.P. and the learned counsel for the complainant. They have opposed the prayer for bail on the ground that they have misappropriated more than Rs.15 lac and the petitioner was also actively participated in that. . Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, surrender before the court below within a period of six weeks from the date of receipt of order and on surrender he will be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-V, Danapur in connection with Complaint Case No.490© of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
