Learned counsel for the petitioner seeks permission to withdraw this bail application on behalf of petitioner no.1. Permission, as prayed for, is granted. Accordingly, this bail application is dismissed as withdrawn as against petitioner no.1.

In this case, the petitioner no.2 is seeking anticipatory bail in connection with Rosera P.S. Case No. 321 of 2017, registered for the offence punishable under Sections 395, 412 and 120B of the Indian Penal Code.

Looking to the nature of allegation, this Court is not

Patna High Court Cr.Misc. No.58277 of 2018(2) dt.28-09-2018 2/2 inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. However, if the petitioner no.2 surrenders before the Court below within four weeks from today and prays for regular bail, the Court below will consider the same and pass appropriate order after calling the case diary.
