The Petitioner seeks regular bail in connection with Special Case No. 3745 of 2018 arising out of Bihta P. S. Case No. 395 of 2018, registered for offences punishable under Sections 30 (a) of Bihar Excise and Prohibition Act.
As per F.I.R. allegation against the petitioner is that recovery of 400 liters of country made liquor from the possession of the petititioner along with other co-accused person. It is also alleged that the petitioner is an accused in one more case also. Submission of the learned counsel for the petitioner is that the petitioner has falsely been implicated in this case and allegation against the petitioner is false and concocted and no
Patna High Court Cr.Misc. No.63872 of 2018 (2) dt.25-10-2018 2/2 evidence is available to show the involvement of the petitioner in this case and the petitioner is in custody since 09.08.2018. Heard learned A.P.P. who opposes the prayer for bail. In view of the discussions made above, this application is disposed of with direction to the Court below to release on bail to the petitioner after completion of the period of three months of his custody to his own satisfaction on condition that he will co-operate in disposal of trial. With the aforesaid observation, the instant petition is disposed of.
