Petitioner seeks bail in a case registered for the offences punishable under Section 354 of the Indian Penal Code and Sections 8, 10 of POCSO Act.
Petitioner was caught on the spot while he was teasing the informant's niece aged about 14 years. Submission on behalf of the petitioner is that petitioner is in jail custody since 24.06.2016 and as a matter of fact, the present case was lodged under misconception and later on, the informant as well as so-called victim compromised the case and the compromise petition has already been filed before the
Patna High Court Cr.Misc. No.31510 of 2016 (2) dt.12-08-2016 2/2 court below.
Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that petitioner does not have any criminal antecedent, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge-cum- Special Judge, Bettiah, West Champaran in connection with Bairiya P.S.
