The petitioners apprehend their arrest in connection with Punpun P.S. Case No. 79 of 2017, registered under Sections 147, 148, 149, 323, 504, 325, 307, 337, 354/354(B), 379, 427 and 504 of the Indian Penal Code.

The accusation is that, on 12.03.2017, 18 persons named in the F.I.R. including the petitioners started to abuse the family members of informant, Jageshwari Devi. When she made protest then all started to unfold her sari with bad intention and assaulted her. On raising alarm, Ramakant Singh, Shayamkant Singh,

No.18717 of 2019(4) dt.25-06-2019 2/2 Tuntun Kumar, Mithlesh Prasad and Surendra Mahto reached there to save her then they were also assaulted by accused persons named in the F.I.R. including the petitioners through lathi and danda. In the meantime, Gulab Kewat, Talu Kewat, Maklesh Kewat, Santosh Kewat and Dharmendra Kewat (petitioner no.3) entered in her house and tor sari of her daughter-in-law and tried to outrage her modesty. Learned counsel for the petitioner submits that, in fact, due to enmity occurrence took place, in which, petitioners' side also sustained injury, regarding which, Punpun P.S. Case No. 78 of 2017 is also instituted on the basis of written report of co-accused, Santosh Kewat. Moreover, the injuries, as found on the person of the informant and other injured, are simple in nature.

Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Masaurhi, Patna, in connection with Punpun P.S. Case No. 79 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
