Mr. Chandra Bhushan Prasad ====================================================== CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 23-04-2025 Heard the learned senior counsel for the petitioners, Sri Krishna Pd. Singh and learned APP for the State.
2. The petitioners seek regular bail in connection with Dehri Rail P.S. Case No. 21 of 2024 registered for the offence under Sections 143(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 79 of the JJ Act.
3. Though the allegations against the petitioners is of human trafficking of minors but from the Adhaar Cards of the alleged victims, it appears that the victims are not minor but are major and they were going to earn their livelihood.
4. Learned counsel for the petitioners submits that petitioners are innocent and have not committed any offence.

5. Learned A.P.P. has vehemently opposed the prayer for bail.
6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.
7. Accordingly, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Railway Court, Gaya/concerned Court below in connection with Dehri Rail P.S. Case No. 21 of 2024 subject to condition that:- i). Before accepting the bail-bonds of the petitioners, the Court below will verify the antecedent of the petitioners. If the petitioners are found having clean antecedent, then the bail-bonds of the petitioners shall be accepted. If the petitioners are found having criminal antecedent(s), then their bail-bonds shall not be accepted by the court below.
(ii) The petitioners shall appear in the trial regularly either personally or through their lawyer and shall cooperate in the trial and non-cooperation in the trial shall result in cancellation of the bail bond of the petitioners.
(iii). Both the bailors should be local.

8. The Court below is directed to conclude the trial within six months from today.
