The petitioner is accused in connection with Pirpaiti P.S. Case No. 229 of 2016 registered under Sections 3, 4, 5, 6 and 7 of the Immoral Traffic (Prevention) Act, 1956 and Section 32 and 37(B) of the Bihar New Excise Act, 2016.

The accusation is that in course of raid in Hotel Anand Bihar, petitioner being the Manager-cum-owner was found in a room, while he was tried to flee away but he was apprehended. On search, registers of Hotel, some cash and other objectionable materials were recovered. In another room, a girl in suspicious condition was also apprehended and objectionable material recovered. Patna High Court Cr.Misc. No.2403 of 2017 (2) dt.03-02-2017 has disclosed that she used to come here for earning as she belonging to the poor family.

Learned counsel for the petitioner submits that it would appear from the F.I.R. that petitioner, who is owner of Hotel, was found in a room and the girl was found in another room of the Hotel. It is further submitted that the bottles of the beer, which are said to be recovered from the Varandah of the Hotel, were empty. Further submission is that petitioner has no criminal antecedent and he is in custody since 30.11.2016. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.-XI, Bhagalpur, in connection with Pirpaiti P.S. Case No. 229 of 2016. Out of two sureties, one surety must be the close relative of the petitioner.
