ANJANA MISHRA ORAL ORDER 28-09-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner has been in custody on his remand since 23.06.2018 in connection with Ara Nawada P.S. Case No. 271/2018 registered for the offences punishable under Sections 379 of the Indian Penal Code.

Learned counsel for the petitioner submits that for the same occurrence of theft of motorcycle, two cases were registered. One being Shahpur P.S. Case No. 116 of 2018 as well as the present case. It is further submitted that in Shahpur P.S. Case No. 116 of 2018, in which he was taken into custody on 02.05.2018 as he was apprehended with the stolen motorcycle, the petitioner has since been extended the privilege of bail in Cr.

Patna High Court Cr.Misc. No.59443 of 2018 (2) dt.28-09-2018 2/2 Misc. No. 49293 of 2018 vide order dated 27.08.2018. Considering the aforementioned facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Ara at Bhojpur, in connection with Ara Nawada P.S. Case No. 271/2018.
