JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Sections 47(A), 53 of Excise Act.

200 litres toddy are said to have been recovered from the house of the petitioner and petitioner and one co-accused, Karmu Choudhary were caught on the spot. The learned Sessions Judge denied the bail to the petitioner on the ground that there is certain exception in the notification of State Government whereas granted bail to co-accused, Karmu Choudhary.

Considering the aforesaid facts and circumstances as

No.28902 of 2016 (2) dt.25-07-2016 2/2 well as submissions of the parties and also taking note of this fact that petitioner is in jail custody since 14.05.2016 and does not have any criminal antecedent, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Barun P.S. Case No. 68 of 2016.
