The petitioners in the present case are seeking prearrest bail in connection with Islampur P.S. Case No.- 446 of 2021 registered for the offences punishable under Sections 406, 420, 467, 468, 471, 120(B) of the Indian Penal Code. They have got no criminal antecedent.

Learned counsel for the petitioners is permitted to make correction in the prayer portion of the application. Learned counsel for the petitioners submits that the present FIR has been lodged on the allegation that after selection of the petitioners as Teachers their certificates were found to be forged one after verification.

Patna High Court CR. MISC. No.20983 of 2023(2) dt.24-06-2023 2/3 Learned counsel for the petitioners submits that the petitioners are innocent and have been falsely implicated in this case. It is submitted that no payment was made to the petitioners after their selection.

Learned APP for the State has opposed the prayer for anticipatory bail of the petitioners.

Having regard to the facts and circumstances of the case, wherein these petitioners are said to have submitted forged certificate but the fact remains that they were appointed and no payment was made to them as also that they have no criminal antecedent, this Court directs that in case of their arrest or surrender within a period of four weeks from today, the petitioners above named shall be released on bail in connection with Islampur P.S. Case No.- 446 of 2021 on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate Ist, Hilsa, Nalanda, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

And further condition that the court below shall verify the criminal antecedent of the petitioners and in case, at any stage, it is found that the petitioners have concealed their

However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
