2. The present criminal miscellaneous application has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'the BNSS, 2023') for grant of anticipatory bail to the petitioners who apprehend arrest in connection with Tajpur (Halai O.P.) P.S. Case No. 308 of 2022, lodged on 01.07.2022, under Sections 302/201/34 of the Indian Penal Code.

3. As per the prosecution, the FIR has been lodged against eight named accused persons including the present petitioners against whom allegation is that they demanded

Patna High Court CR. MISC. No.22361 of 2025(3) dt.02-07-2025 2/3 money from the informant's brother when he denied they assaulted and snatched the key of motorcycle. When the informant came to the sasual of his brother, the informant did not find his brother there. It is also alleged that at 5:00 AM in the morning the informant found the deceased hanging in a bamboo tree.

4. Learned Counsel for the petitioners submits that the petitioners are innocent and have committed no offence. Counsel submits that there is general and omnibus allegation against the petitioner. Counsel submits that there is no eyewitness to the occurrence. Counsel submits that antecedent of the petitioners are clean and they are ready to fulfill all the conditions whatsoever shall be imposed upon them.

5. Learned APP for the State opposes the prayer for bail of the petitioners and submits that the witnesses have supported the case of the prosecution. Counsel submits that deceased went to his sasural where the accused persons demanded money, assaulted the deceased and on the next day his dead body was found hanging from the bamboo tree near his sasural.

6. Considering the nature of allegation against the petitioners, this Court is not inclined to grant anticipatory bail to
