The petitioner seeks bail in Hajipur Town P.S. case No. 329 of 2016 registered under Section 392 of the Indian Penal Code and under Section 27 of Arms Act.

The informant alleged that while he was returning to his house after carrying a bag containing Rs. 2, 10,000/- four miscreants came on two motor cycles and snatched the bag containing money after making firing.

The learned counsel for the petitioner submits that petitioner is not named in the FIR. The name of petitioner figured in the case in the confessional statement of co-accused Umesh Rai @ Mutan but nothing has been recovered from the possession of

Patna High Court Cr.Misc. No.58599 of 2018 (2) dt.20-09-2018 2/2 the petitioner. The petitioner has not been put in T.I. Parade. The petitioner is in jail since 11.07.2018.

Considering the facts that name of the petitioner surfaced in the case in the confessional statement of co-accused and on such basis the petitioner was arrested on 11.07.2018 but he was not put in T.I. parade, the petitioner, above named, is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Town P.S. case No. 329 of 2016.
