Petitioner seeks bail in connection with Bihpur P.S. Case No. 147 of 2018 (G.R. No. 434 of 2018) registered for the offence punishable under sections 448, 341, 354(B), 376 and 511 of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that merely on the basis of some ulterior motive petitioner has falsely been implicated in this case. Not a single independent witness has supported the case of prosecution. I.O has not submitted charge sheet under Section 376 and 511 of the I.P.C. rather he has submitted charge sheet under Section 448, 442 and 354B of the I.P.C. Petitioner has no criminal antecedent and is in custody since 05.04.2018.

Considering the facts and circumstances of the case

Patna High Court Cr.Misc. No.58376 of 2018(2) dt.28-09-2018 2/2 and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate 1st Naugachia, District Bhagalpur in connection with Bihpur P.S.
