Petitioner is in custody in connection with Nathnagar (Madhusudanpur) P.S. Case No. 321 of 2019 for the offence under section302/34 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner submits that allegation of assault is not against this petitioner. It is alleged that the petitioner caught hold the victim and others assaulted the victim.

The petitioner is in custody since 21.11.2019. Learned counsel for the petitioner submits that petitioner has no criminal antecedent. He is Sarpanch and as a Sarpanch he tried to pacify the dispute between the parties and as such he has been roped in the present case.

No.17526 of 2020(4) dt.24-03-2021 2/2 Considering the fact that the petitioner has remained in custody for more than one year, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 50,000/- (Fifty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur, in connection with Nathnagar (Madhusudanpur) P.S. Case No. 321 of 2019.
