JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 10-02-2017 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner apprehends his arrest in connection with Mehsi P.S. Case No. 161 of 2014 (G.R. No. 4218 of 2014) registered for the offences punishable under Sections 447, 341, 324, 325, 307, 379, 504, 506/34 of the Indian Penal Code and Section 3/4 of Prevention of Witch (Daain) Practices Act. Allegedly, in the occurrence the petitioner assaulted with rod on the head of the informant causing rapture and bleeding and all started pulling the informant and assaulted her and further co-accused Surendra Rai snatched nose ring, ear tops and gold chain.

Submission is of false implication and that the informant has received sharp cut injury which is simple in nature

Patna High Court Cr.Misc. No.2866 of 2017 (2) dt.10-02-2017 2/2 and, as such, the allegation as alleged against the petitioner is not substantiated and, as such, the petitioner deserves sympathetic consideration.

The learned A.P.P. opposes the prayer of bail. In the facts and circumstances as stated above, considering the injury report, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, at Motihari, in connection with Mehsi P.S. Case No. 161 of 2014, corresponding to G.R. Case No. 4218 of 2014, subject to the conditions as laid down in section 438(2) of the Cr.P.C.
