JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-10-2018 Earlier prayer for bail of the petitioner was dismissed twice vide order dated 27.04.2017 passed in Cr. Misc. No. 10669 of 2017 and vide order dated 18.10.2017 passed in Cr. Misc. No. 47941 of 2017 and the allegation against the petitioner is of commission of rape on the informant.

Submission of learned counsel for the petitioner is that he has been in judicial custody since 02.01.2017 and there is no substantive progress in trial and earlier there was direction to the trial court to conclude the trial within a period of nine months but the trial has not been concluded.

Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case and the nature of allegation, I am not inclined to enlarge the petitioner on bail.

Patna High Court Cr.Misc. No.60970 of 2018 (2) dt.03-10-2018 2/2 However, since the petitioner has been in custody since 02.01.2017, the trial court is directed to expedite the trial and conduct it on day to basis so that the trial be concluded within a reasonable period of time.

At the same time, S.P. Nawada is also directed to ensure the production of witnesses in the trial court on the date fixed, so that the trial be concluded expeditiously. With the above observation, this application is dismissed.
