Mr.Akbar Ali ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 23-06-2020 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Bettiah (Nagar) P.S. Case No. 715 of 2019 for the offence under Sections 302, 201, 120(B) of the Indian Penal Code. In this case, case diary was called for.

Learned counsel for the petitioner submits that the petitioner was not named in the F.I.R. and his name has surfaced on the basis of confessional statement of co-accused Sidhant Anand. He further submits that the aforesaid Sidhant Anand has been granted bail by a co-ordinate Bench of this Court vide order dated 12.02.2020 passed in Cr. Misc. No. 12821 of 2020. He also submits that there is no direct allegation against the petitioner to connect in the commission of crime. The petitioner is in custody since 15.12.2019 and he has got no criminal

Considering the fact that the petitioner has got no criminal antecedent and the co-accused, namely, Sidhant Anand has been granted bail by a co-ordinate Bench of this Court, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bettiah (West Champaran) in connection with Bettiah (Nagar) P.S. Case No. 715 of 2019 with the condition that on release the petitioner will render his service as volunteer for a period of one month in dedicated Covid Hospital. He is required to report to the District Nodal Officer in the concerned region, who shall utilize his service in this pandemic.
