====================================================== CORAM: HONOURABLE MR. JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-09-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 272, 273 and 420 of the Indian Penal Code and 47(a) of the Bihar Excise Act. 4400 liters of spirit were recovered from a truck when four persons were found fleeing away toward the village who were standing near the truck. The petitioner was one of them. It is submitted by learned counsel for the petitioner that recovery is not made from the petitioner and other accused have been granted regular bail by this Court vide Cr. Misc. No. 22555 of 2015 and 28967 of 2015.

The aforesaid facts constitute good ground for consideration of prayer for regular bail.

Let the learned court below consider the prayer for

Patna High Court Cr.Misc. No.36078 of 2015 (2) dt.07-09-2015 2/2 regular bail of the petitioner if he surrenders within a period of six weeks in connection with Baniyapur P.S. Case No. 36 of 2015 pending in the court of learned CJM, Saran at Chapra. It is expected from the learned court below to dispose of the regular bail application of the petitioner preferably on the same day.

Accordingly, the application is disposed of.
